Rental agreements and najem okazjonalny
Understand the written terms and extra documents required for an occasional tenancy before visiting a notary.
Identify the tenancy type
Ask whether this is an ordinary residential tenancy, najem okazjonalny or an institutional arrangement. Rules and protections differ. Check the parties, property, permitted occupants, fixed or indefinite duration, rent, charges, repairs and termination. Obtain a written version you understand and keep every attachment.
Check an occasional tenancy
Najem okazjonalny generally uses a written fixed-term agreement and a tenant’s notarial declaration submitting to enforcement of the duty to vacate. The usual supporting documents identify another dwelling and its owner’s consent. This is not the same as simply witnessing signatures; ask the notary to explain the consequences and costs before signing.
Check protection-related exceptions
For a tenant who is a beneficiary of temporary protection, Article 112e provides an exception to the alternate-dwelling and related consent requirements. Do not assume every Ukrainian citizen or every foreign tenant qualifies. Show current status documents to the notary or adviser; the exception does not remove all other occasional-tenancy formalities.
Complete and keep the paperwork
Clarify the landlord’s tax-office notification and ask for confirmation where applicable. Keep the agreement, attachments, notarial document, deposit proof and handover report. Do not sign blank declarations. If the contract label or missing attachment is disputed, obtain advice rather than assuming the whole tenancy is automatically void or that immediate lock-changing is allowed.
